Amendment of Road Transport Regulations, cancellation of double cards for 4.5 tons

In accordance with the Decision, the third item of Article 22 of the Regulations of the People's Republic of China on Road Transport was amended as follows: (3) The municipal road transport administrative organs with districts have passed the examination on the basic knowledge of relevant freight laws and regulations, motor vehicle maintenance and cargo loading and storage (except drivers who use ordinary freight vehicles with a total quality of 4500 kg or less).
Article 24 adds one paragraph as the third paragraph: "If a general cargo vehicle with a total mass of 4500 kg or less is used for general cargo operation, it is not necessary to apply for a road transport operation license and a vehicle operation license in accordance with the provisions of this article." Delete the "application" in Article 37. An additional paragraph shall be added as the second paragraph: "The competent department of transportation under the State Council shall, in accordance with the conditions specified in the preceding paragraph, formulate operational standards for motor vehicle maintenance and operation."
Delete the words "motor vehicle maintenance and operation" and "Article 37" in Article 39. An additional paragraph shall be added as the second paragraph: "Those engaged in motor vehicle maintenance and operation business shall, after going through the relevant registration formalities with the administrative authorities for Industry and Commerce in accordance with the law, file with the county-level road transport administrative organs where they are located, and attach relevant materials meeting the requirements specified in Article 37 of these Regulations." Paragraph 2 of Article 43 is amended as follows: "Motor vehicle maintenance operators shall publish the fixed working hours and charging standards for motor vehicle maintenance, collect reasonable fees, and provide detailed lists of maintenance fees after completion of maintenance services."
Delete the words "motor vehicle maintenance and operation" in Article 65. Two additional sections shall be added as the second and third paragraphs: "If motor vehicle maintenance and operation fails to meet the operational standards for motor vehicle maintenance and operation formulated by the competent traffic department under the State Council, the road transport administrative agency at or above the county level shall order it to make corrections; if the circumstances are serious, the road transport administrative agency at or above the county level shall order it to suspend operation and rectify it." "Those who engage in motor vehicle maintenance and operation business and fail to file as required shall be ordered to make corrections by the road transport administration agencies at or above the county level; those who refuse to make corrections shall be fined not less than 5,000 yuan but not more than 20,000 yuan."
Article 72 and Article 73 "If the circumstances are serious, the original licensing authority shall revoke its business license" to read "If the circumstances are serious, the road transport administrative agency at or above the county level shall order the suspension and rectification". An additional article shall be added as Article 76: "The administrative agencies of road transport at or above the county level shall record the illegal acts committed by road transport operators and practitioners and publicize them in accordance with relevant laws and administrative regulations."
In addition, the words "entry-exit inspection and quarantine" in Article 5, paragraph 1, Article 6 and Article 16, paragraph 2, of the Provisional Regulations on Express Delivery are deleted. In the third paragraph of Article 26, paragraph 2, delete the words "if there are any articles that should be quarantined according to law, they shall be dealt with by the entry-exit inspection and quarantine department according to law".
